ISC NegativeEasements

A “Negative Easement” is a restriction attached to a property in which any water development or use, usually including drilling of domestic wells, is not allowed unless a transfer of valid and existing water rights is made to the land. The purpose of the water rights purchases was to reduce depletions in the basin, making restricting water use on these properties important.
